- If you use even a small box truck or pickup & trailer combination with a total (truck & trailer, if any) manufacturer's Gross Vehicle Weight Rating (or actual loaded weight) of 10,001 lbs. or more for a business purpose,
you are probably regulated as a "Commercial Motor Vehicle (CMV)." Not just tractor-trailer rigs are effected by DOT / FMCSA & State trucking regulations but depending on where you operate even lawn care, heating & air conditioning companies, etc. are regulated. Many municipalities and state governments have "discovered" a new source of revenue in these tough times by newly enforcing regulations which have always technically applied to smaller CMVs. - If you operate a CMV across state lines for business purposes, you are regulated by US Department of Transportation's
(DOT) Federal Motor Carrier Safety Regulations (FMCSR). - If you operate trucks solely within one state, you are probably regulated by your state under similar rules. Many states have adopted the FMCSRs as their rules for intrastate (within one state) truck safety regulation.
- Some will tell you that compliance with these regulations will cost you thousands of $$,$$$ and untold hundreds of hours. NOT TRUE!! Non-compliance could though.
- DOT / FMCSA, State regulators and law enforcement people are NOT your worst enemy. That worst enemy is the opposing lawyer in an accident-related lawsuit.
